Terms of Service

1. Acceptance of Terms

By accessing or using the MEDelivery mobile application, operated by Mundus Marais Kraft, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, you may not access the app or use any services.

2. Description of Service

MEDelivery provides an online platform that connects users with partner restaurants for food ordering and delivery services. We act as an intermediary between you, the restaurant, and the independent delivery partners.

3. User Accounts

• You must create an account to use certain features of the app.
• You are responsible for maintaining the confidentiality of your account and password and for restricting access to your device.
• You agree to accept responsibility for all activities that occur under your account.

4. Orders and Payments

• All orders placed through the app are subject to availability and acceptance by the respective restaurant.
• Prices are listed in South African Rand (ZAR) and include applicable taxes unless otherwise stated.
• Payments are processed securely via our third-party payment provider (Paystack). By placing an order, you authorize us to charge your selected payment method.

5. Delivery

• Delivery times provided are estimates and are not guaranteed.
• Delivery partners are independent contractors. MEDelivery is not responsible for the actions, omissions, or behavior of any delivery partner.

6. Prohibited Uses

In addition to other prohibitions as set forth in the Terms of Service, you are prohibited from using the app or its content:

• For any unlawful purpose.
• To solicit others to perform or participate in any unlawful acts.
• To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances.

7. User Content and Conduct

Users may have the ability to post ratings, reviews, or other content. You are solely responsible for the content you submit. We reserve the right, at our sole discretion, to monitor, edit, or remove any content that we determine to be unlawful, offensive, threatening, libelous, defamatory, or otherwise objectionable.

8. Limitation of Liability

In no case shall MEDelivery, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind arising from your use of any of the service or any products procured using the service.

9. Governing Law

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of South Africa.

10. Changes to Terms of Service

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our app. It is your responsibility to check our app periodically for changes.
